Terms of Service

Last updated: October 28, 2026

Draft: this document has not yet been reviewed by a lawyer and may change before Dispatch44 takes paying customers.

1. About these terms

These terms are an agreement between Dispatch44 LLC ("we", "us") and the business that signs up for the Dispatch44 app (the "Customer", "you"). The person who creates the company account, or accepts an owner invitation, confirms they are allowed to accept these terms for that business.

The Customer's employees (owners, dispatchers and drivers) who use the app ("Users") must also follow these terms. The Customer is responsible for its Users.

How we handle personal information is explained in our Privacy Policy, which is part of these terms.

2. The service

Dispatch44 is web-based dispatch software for towing, roadside, moving and fleet service businesses. It includes a dispatch board, a live map of jobs and on-shift drivers, a mobile web app for drivers, call handling through the Dispatch44 AI voice agent, text messages to customers, follow-up of missed calls ("Win Back"), price lists and reports (together, the "Service").

We may improve or change the Service over time. If we remove a major feature you pay for, we will tell you in advance.

3. Accounts and security

  • Give accurate information when you sign up and keep it up to date.
  • Keep logins private. Each User must have their own login; do not share accounts.
  • Owners decide who joins the company account and can turn off a User's access at any time.
  • Tell us straight away at support@dispatch44.com if you think an account has been used without permission.

4. Fees and billing

  • New companies get a 7-day free trial. Your card is collected when you sign up and is first charged when the trial ends, unless you cancel before then. Setup is free.
  • After the trial, the Service is billed monthly or yearly, in advance, for the plan you choose. Each plan has a maximum number of active trucks and AI call minutes per month. Prices are shown before you subscribe and on your Billing page.
  • Payments are processed by Stripe. Your subscription renews automatically at the end of each billing period until cancelled.
  • You can cancel at any time from the Billing page. Cancellation takes effect at the end of the period you have paid for (or at the end of the trial, if you cancel during it). We do not refund partial periods, except where the law requires it.
  • Prices do not include taxes unless stated. You are responsible for any applicable taxes.
  • If a payment fails, we will let you know. If it is not fixed, we may pause your account until it is paid. Pausing does not delete your data.
  • We may change our prices with at least 30 days' notice. New prices apply from your next billing period after the notice period.

5. Your responsibilities

You agree to use the Service lawfully, and in particular:

  • Employee location tracking. The driver app shares a driver's location only while they are on shift, and asks each driver to accept a location notice first. You are responsible for telling your employees about tracking and getting any consent the laws where you operate require.
  • Call recording. The AI voice agent can record and transcribe calls and is set up to tell callers that calls may be recorded. Some US states and Canada require the consent of everyone on a call. You are responsible for making sure recording is lawful where you and your callers are.
  • Text messages. Only text people who contacted you or agreed to receive texts about their job. Opt-out requests (STOP) are honoured automatically; do not try to get around them. You are responsible for following texting laws such as the US Telephone Consumer Protection Act and Canada's anti-spam law.
  • Your customers' information. Only enter information you are allowed to collect, and tell your customers how you use it.

6. AI voice agent, quotes, maps and emergencies

  • The AI voice agent can mishear, misunderstand or make mistakes. Check jobs it books before dispatching, especially addresses and phone numbers.
  • Prices the agent or the app quotes are estimates from your own price list. You are responsible for your prices and the final amount you charge.
  • Map positions, routes, distances and arrival times are estimates and can be wrong or delayed.
  • Dispatch44 is not an emergency service. It does not replace 911. Callers in danger are told to call 911, but you must not rely on the Service for anyone's safety.

7. Your data

You own the information you and your Users put into the Service, and the information the Service collects for you (such as calls, jobs, photos and customer details) ("Customer Data"). We use Customer Data only to provide, secure, support and improve the Service for you, as described in our Privacy Policy. We do not sell it.

You can ask us for a copy of your Customer Data at any time. After your account ends, we keep it for 90 days in case you come back, then delete it (backups are deleted within a further 30 days), unless the law requires us to keep it longer.

8. Acceptable use

You must not:

  • break the law, or use the Service to harass, deceive or spam anyone;
  • try to access another company's data, test our security without written permission, or get around usage limits;
  • copy, resell or reverse-engineer the Service, or use it to build a competing product;
  • upload anything harmful (such as viruses) or content you don't have the right to use.

9. Other companies' services

The Service relies on trusted providers, for example Supabase (database and logins), Netlify (hosting), Stripe (payments), Twilio (texts), Retell (AI voice agent), Mapbox (maps) and GitHub (backups). Their availability can affect the Service. We choose them carefully but are not responsible for their own terms or outages.

10. Availability and support

We work to keep the Service running and back up its database every night, but we cannot promise it will always be available or free of errors. We may need short maintenance breaks; we will try to schedule them outside busy hours. Contact us at support@dispatch44.com for help.

11. Disclaimers

Apart from what these terms expressly promise, the Service is provided "as is" and "as available". To the extent the law allows, we make no other promises, including that the Service is fit for a particular purpose.

12. Limits on liability

To the extent the law allows: (a) neither of us is liable to the other for indirect or consequential losses, such as lost profits, lost business or lost data; and (b) our total liability for all claims about the Service is limited to the fees you paid us in the 12 months before the claim arose. These limits do not apply where the law does not allow them, such as for fraud.

You agree to cover our reasonable costs if a claim is brought against us because of how you or your Users used the Service in breach of these terms or the law (for example, unlawful texting, recording or tracking).

13. Suspension and ending the agreement

  • You can stop using the Service and cancel at any time from the Billing page.
  • We may pause or end your account if you don't pay, break these terms, or put the Service or others at risk. Where reasonable, we will warn you first and give you time to fix the problem.
  • If we decide to stop offering the Service, we will give at least 30 days' notice and help you get a copy of your data.

14. Changes to these terms

We may update these terms. If a change matters, we will tell account owners in the app before it takes effect, and owners will be asked to accept the new version. If you don't agree, you can cancel before the change applies.

15. Governing law

These terms are governed by the laws of the State of [to be confirmed], United States, without regard to its conflict of law rules. Before going to court, we both agree to try to solve any dispute by talking first.
